These Terms govern your use of the Cupmark app and this website. By creating an account or using Cupmark, you agree to them.
You need an account to use most of Cupmark's features. You're responsible for keeping your login credentials secure and for all activity under your account. You must provide accurate information when creating an account, and you must be old enough to consent to these Terms in your jurisdiction — Cupmark is not directed at children under 13 (see our Privacy Policy).
Use Cupmark honestly and don't try to break it. Specifically, don't:

Cupmark lets you publish recipes, cupping/experiment results, and other content to the community. You retain ownership of what you create. By publishing content, you grant Cupmark a non-exclusive, worldwide, royalty-free license to display, distribute, and promote that content within the app and its marketing, for as long as it stays published. You're responsible for the content you post, and it must be accurate to the best of your knowledge — recipes and results shared with the community are meant to reflect a real attempt, not fabricated data.
We reserve the right to remove content or moderate community activity that violates these Terms, at our discretion, without prior notice.
AI Coach responses may be inaccurate or not suited to your specific equipment, water, or ingredients. Always use reasonable judgment — particularly around food safety topics such as water temperature, equipment cleanliness, or ingredient freshness — and don't rely on AI Coach as your sole source of guidance for anything safety-related. Cupmark is not liable for outcomes resulting from following AI Coach suggestions.
Cupmark, its logo, in-app content (lessons, quiz content, illustrations, and the app's design), and underlying software are owned by Cupmark or its licensors and protected by applicable intellectual property laws. Except for the license you're granted to use the app under these Terms, and the license you grant us to your own published content under Section 4, no rights are transferred to you.
Cupmark is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee the app will be uninterrupted, error-free, or that any specific brewing outcome or skill result will be achieved from using it.
To the maximum extent permitted by law, Cupmark and its team are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the app — including any brewing outcome, equipment issue, or decision made based on in-app guidance (including AI Coach). Where liability can't be excluded, it's limited to the amount you paid for the service in the 12 months before the claim arose.
You can stop using Cupmark and delete your account at any time — see Account Deletion. We may suspend or terminate your access if you violate these Terms, engage in fraudulent or abusive activity, or if required by law. Where reasonably possible, we'll notify you before or promptly after taking that action.
We may update these Terms as the app evolves. If we make a material change, we'll update the "Last updated" date and, where appropriate, notify you in the app. Continuing to use Cupmark after a change takes effect means you accept the updated Terms.
These Terms are governed by the laws applicable to Cupmark's place of business, without regard to conflict-of-law principles, except where local consumer-protection law requires otherwise.
